A Middlesboro man has been charged with burglary, terroristic threatening, disorderly conduct, menacing, resisting arrest, and criminal mischief after barricading himself in his wife’s residence Friday afternoon.
According to a release from the Bell County Sheriff’s Department, Deputy Jody Risner and Chaplain Allen Sanders were dispatched to Ferndale Apartments in reference to 33-year-old Joshua Shane Henderson entering his wife’s residence without permission, to remove items at approximately 2 p.m.
On scene the deputies made contact with Henderson and he appeared to be under extreme duress exhibiting behavior consistent with being manifestly under the influence. He refused to open the door stating he was getting his property and leaving. He then stated he would not let the deputies in and began to barricade the door screaming “come get me.”
After other deputies and officers arrived to assist, Deputy Hunter Luttrell made contact with Henderson who stated he had a refrigerator and all of his furniture in front of the door. Out of abundance of caution, residents to the adjoining apartment were then evacuated and a standoff ensued. Deputies attempted to coax Henderson to put down knives he was in possession of and come out of the apartment. He refused and repeatedly stated that those on scene would have to kill him.
Barbourville K-9 Sgt. Eric Martin and Police Chief Winston Tye were requested to the scene to use less than lethal rounds to force Henderson out of the apartment. The rounds were inserted through the window striking Henderson.
After Deputy Luttrell and Chief Deputy Jared Smith negotiated with Henderson further, he threw his weapons out the window, surrendered, and was taken into custody at 5:38 p.m. It was found that substantial damage had been done to the inside of the apartment.
Henderson was arrested and lodged in the Bell County Detention Center charged with burglary – 2nd degree, terroristic threatening – 3rd degree, disorderly conduct – 1st degree, menacing, resisting arrest, and criminal mischief – 1st degree.
Also assisting on scene was Bell County EMS, Bell County Volunteer Fire Department, Middlesboro Police, and Pineville Police.
