Officer Capps took out a criminal complaint warrant on Miniard on Aug. 6.

The complaint states that Capps reported that on June 24 Miniard committed the act of rape in the third-degree having sexual intercourse with a female under the age of 16.

The Kentucky Revised Statute 510.060 reads that a person is guilty of rape in the third degree when: (b) being twenty-one (21) years old or more, he or she engages in sexual intercourse with another person less than sixteen (16) years old.

Miniard is being held on a $100,000 cash bond.
