A Middlesboro business owner was arrested on Sept. 14 on charges of alleged EBT fraud.

William Wilcox, 67, owner of Bill’s Market, was charged with similar crimes in November 2015, according to a report in the Middlesboro Daily News.

He is still awaiting trial on the 2015 charges.

Wilcox was lodged in the Bell County Detention Center after his arrest Thursday and charged with five new counts of trafficking/fraudulent use/possession of an EBT card.

On Dec. 24, 2015, Wilcox was indicted on nine counts of fraudulently sold merchandise to informants using EBT cards in the months of August, September and October.

According to the nine-count indictment, Wilcox fraudulently used an EBT card on or around Aug. 31, 2015 when he, with the intent to defraud, knowingly sold an informant working with the Middlesboro Police Department, a pack of Marlboro cigarettes for the purchase price of $5, accepting payment from an EBT card provided to the informant from the MPD.

The indictment further states that on or about Sept. 1, Wilcox fraudulently used an EBT card when he, with the intent to defraud, knowingly sold an informant working with the MPD a pack of Marlboro cigarettes and a box of cigarette tubes for the purchase price of $8, accepting payment from an EBT card provided to the informant from the MPD.

Count three of the indictment states that on or about Sept. 14, Wilcox fraudulently used an EBT card when he knowingly sold an informant working with the MPD two packs of Marlboro cigarettes for the purchase price of $10.80, accepting payment from an EBT card provided to the informant from the MPD.

The indictment further stated that on or about Sept. 22, Wilcox fraudulently used an EBT card when he knowingly sold an informant working with the MPD two packs of Marlboro cigarettes for the purchase price of $9.80, accepting payment from an EBT card provided to the informant from the MPD.

According to count five of the indictment on or about Oct. 21, Wilcox fraudulently used an EBT card when he knowingly sold an informant working with the MPD a carton of Marlboro cigarettes for the purchase price of $44.49, accepting payment from an EBT card provided to the informant from the MPD.

Counts six through nine said that when Wilcox was arrested on Nov. 5, he was in the possession of four EBT cards belonging to other individuals.

An indictment does not indicate guilt. It does indicate that the grand jury found there was enough evidence to warrant sending the case to trial.

Wilcox was lodged in the Bell County Detention Center Sept. 14 on a $2,500 bond.

Middlesboro Police Officers Nick Capps and Michael Bradley led the investigation.
